Terms of Service

The terms and conditions governing your use of the CrabGlamp platform, services, and cloud development environments.

Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CrabGlamp platform, including the website, dashboard, cloud development environments (“agents”), GlampHub, and all related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

CrabGlamp is operated by CrabGlamp, Inc. (“CrabGlamp,” “we,” “us,” or “our”). “You” or “User” refers to the individual or entity accessing the Service.


1. Eligibility and accounts

1.1 Age requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1.2 Account registration

You must provide accurate, current, and complete information when creating an account. Authentication is handled through Clerk, our third-party identity provider, which supports sign-in via GitHub, Google, or email. You are responsible for maintaining the security of your authentication credentials and for all activity that occurs under your account.

1.3 Account security

You agree to notify CrabGlamp immediately of any unauthorized access to or use of your account. CrabGlamp is not liable for any loss or damage arising from your failure to protect your account credentials.

1.4 Usernames

Each account has a unique username (slug) chosen during onboarding. Usernames are shared across personal accounts and organizations in a single namespace. Usernames cannot be changed after creation. CrabGlamp reserves the right to reclaim or restrict usernames that violate these Terms or that are confusingly similar to CrabGlamp branding.


2. The Service

2.1 Cloud development environments

CrabGlamp provides persistent, isolated cloud virtual machines (“agents”) accessible through a web browser. Each agent includes compute resources, persistent storage, pre-installed development tools, and optional platform-provided LLM API keys.

2.2 GlampHub

GlampHub is CrabGlamp’s public marketplace for publishing, discovering, and downloading agent environment snapshots (“Glamps”). Published Glamps are publicly visible. You are solely responsible for the content of any Glamp you publish, including ensuring it does not contain secrets, credentials, or material that violates these Terms.

2.3 Service availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime via the status page at status.crabglamp.com.

2.4 Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice before making material changes that negatively affect your use of the Service.


3. Billing and payment

3.1 Payment obligation

You agree to pay all fees associated with your use of the Service in accordance with the billing model you select for each agent (pay-as-you-go or subscribe & save). All fees are charged in US dollars.

3.2 Billing models

  • Pay-as-you-go (metered): Billed hourly based on agent state (running or paused). Usage is reported to Stripe hourly and invoiced at the end of each billing cycle.
  • Subscribe & save (flat-rate): A fixed monthly fee per agent slot, billed in advance regardless of usage.

3.3 LLM key billing

Platform-provided LLM keys are billed separately from compute at 1.5x the underlying provider’s cost. Usage is metered and reported to Stripe automatically. See the Pricing & Billing page for details.

3.4 Payment processing

All payments are processed through Stripe. By providing a payment method, you authorize CrabGlamp and Stripe to charge that payment method for all fees incurred. You are responsible for keeping your payment information current. A payment method is required before creating your first agent.

3.5 Failed payments

If a payment fails, Stripe will retry automatically. If payment continues to fail, we may suspend your ability to create new agents. Persistent non-payment may result in account suspension or termination.

3.6 Refunds

Metered usage charges are non-refundable. For subscribe & save plans, unused portions of a canceled subscription are not refunded. We may, at our sole discretion, issue credits or refunds in exceptional circumstances.

3.7 Taxes

Fees are exclusive of taxes unless stated otherwise. You are responsible for all applicable taxes, duties, and levies imposed by taxing authorities in connection with your use of the Service.


4. Acceptable use

4.1 Permitted use

You may use the Service for lawful software development, learning, prototyping, and related purposes. You retain full control over the software, code, and configurations within your agents.

4.2 Prohibited conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Use agents to mine cryptocurrency, run botnets, or conduct distributed denial-of-service attacks.
  • Attempt to gain unauthorized access to other users’ agents, CrabGlamp infrastructure, or any connected third-party systems.
  • Use the Service to store, transmit, or distribute malware, viruses, or other harmful code intended to damage third parties.
  • Resell, sublicense, or redistribute access to the Service without CrabGlamp’s prior written consent.
  • Circumvent or attempt to circumvent any usage limits, billing mechanisms, or security measures.
  • Use the Service to send unsolicited bulk communications (spam).
  • Use platform-provided LLM keys for purposes unrelated to development within your CrabGlamp agents.
  • Publish Glamps to GlampHub that contain malware, stolen code, or content that infringes third-party intellectual property rights.
  • Publish Glamps containing credentials, API keys, or secrets — whether your own or others’.

4.3 Resource limits

Each agent is allocated specific compute, memory, and storage resources based on its size (Hermit Crab, King Crab, or Coconut Crab). You agree not to attempt to exceed these allocations through any means. CrabGlamp reserves the right to throttle or suspend agents that place excessive load on shared infrastructure.

4.4 Enforcement

We may investigate and take action against violations of this section, including suspending or terminating your account, removing Glamps or agent content, or reporting conduct to law enforcement if warranted.


5. Your content and data

5.1 Ownership

You retain all ownership rights to code, files, data, and other content you create, upload, or store within your agents (“Your Content”). CrabGlamp does not claim any intellectual property rights over Your Content.

5.2 License to CrabGlamp

You grant CrabGlamp a limited, non-exclusive license to store, process, and transmit Your Content solely as necessary to provide the Service. This license terminates when you delete Your Content or your account is closed.

5.3 GlampHub content

When you publish a Glamp to GlampHub, you grant CrabGlamp a non-exclusive, worldwide license to host, display, and distribute the published Glamp content for the purpose of operating GlampHub. This license continues until you delete the Glamp. You represent that you have the right to publish all content included in your Glamps.

5.4 Responsibility for content

You are solely responsible for Your Content and for ensuring that it does not violate any applicable law, regulation, or third-party rights. CrabGlamp does not monitor or review the content of agents except as required to provide the Service or comply with legal obligations. CrabGlamp runs automated security scans on Glamps during the staging process but does not guarantee detection of all sensitive content.

5.5 Data retention after termination

Upon account termination, CrabGlamp will retain Your Content for 30 days to allow you to export your data. After this period, Your Content will be permanently deleted. Published Glamps are removed from GlampHub immediately upon account termination. We are not obligated to retain Your Content beyond the 30-day period.


6. Platform-provided LLM keys

6.1 Third-party service

Platform-provided LLM keys give you access to third-party AI models (currently OpenAI) through CrabGlamp. Your use of these models is also subject to the applicable third-party provider’s terms of use and acceptable use policies.

6.2 No guarantee of availability

Platform-provided LLM keys are offered as a convenience. CrabGlamp does not guarantee the availability, performance, or continued offering of any particular model. You may bring your own API keys at any time.

6.3 Content responsibility

You are responsible for the prompts you send through platform-provided LLM keys and for complying with the LLM provider’s usage policies. CrabGlamp does not log or review the content of your LLM interactions.


7. Intellectual property

7.1 CrabGlamp’s rights

The Service, including its software, design, documentation, branding, and all related intellectual property, is owned by CrabGlamp or its licensors and is protected by copyright, trademark, and other applicable laws. These Terms do not grant you any rights to CrabGlamp’s intellectual property except the limited right to use the Service as described herein.

7.2 Feedback

If you provide suggestions, feature requests, or other feedback about the Service, you grant CrabGlamp a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.


8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

CrabGlamp does not warrant the availability, accuracy, or reliability of any third-party service integrated with the platform, including LLM providers, Clerk (authentication), Stripe (payments), or any open-source software pre-installed in agents.


9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRABGLAMP’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO CRABGLAMP IN THE 12 MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL CRABGLAMP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, REGARDLESS OF THE THEORY OF LIABILITY.

The limitations in this section reflect a reasonable allocation of risk and are an essential basis of the agreement between you and CrabGlamp.


10. Indemnification

You agree to indemnify, defend, and hold harmless CrabGlamp and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

  • Your use of the Service.
  • Your Content, including Glamps you publish.
  • Your violation of these Terms.
  • Your violation of any applicable law or third-party rights.

11. Term and termination

11.1 Term

These Terms are effective when you create an account and remain in effect until your account is closed or terminated.

11.2 Termination by you

You may close your account at any time by destroying all agents and contacting support at don@crabglamp.com. You remain responsible for any outstanding charges incurred before closure.

11.3 Termination by CrabGlamp

We may suspend or terminate your account if you violate these Terms, fail to pay outstanding charges, or if we discontinue the Service. We will provide reasonable notice where practicable.

11.4 Effect of termination

Upon termination, your right to use the Service ceases immediately. Sections 5.1 (Ownership), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (General) survive termination.


12. General provisions

12.1 Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

12.2 Dispute resolution

Any dispute arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware. Either party may seek injunctive relief in any court of competent jurisdiction.

12.3 Entire agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and CrabGlamp regarding the Service.

12.4 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

12.5 Waiver

CrabGlamp’s failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

12.6 Assignment

You may not assign these Terms without CrabGlamp’s prior written consent. CrabGlamp may assign these Terms freely in connection with a merger, acquisition, or sale of assets.

12.7 Notices

CrabGlamp may provide notices to you via email to the address associated with your account or through the dashboard. You may contact CrabGlamp at don@crabglamp.com.


13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the dashboard or email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
